Beware of what you put in writing, whether by email, text or letter. An exchange of written communications may result in a legally binding agreement, depending upon on the content. In many states it is not necessary that all terms of an agreement or contract be in one document with a title at the top that reads “Contract” or “Agreement”. At least one court has ruled that the “deal” was made on a napkin.
